Terms of Service

1. Acceptance of Terms

By accessing or using the Lurielle application and website at lurielle.studio (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you (“you” or “User”) and Lurielle (“we,” “us,” or “our”).

2. Description of Service

Lurielle is an AI-powered visual page builder for Shopify stores. The Service allows users to:

  • Design and build store pages using a visual drag-and-drop editor
  • Generate page content and layouts using artificial intelligence
  • Publish pages directly to their Shopify store as native sections and templates
  • Manage and organize pages, sections, templates, and navigation
  • A/B test page variants to optimize conversion rates

The Service is currently under development. Features, availability, and pricing are subject to change.

3. Shopify Store Access

To use the Service, you must connect your Shopify store through Shopify’s OAuth authorization flow. By authorizing Lurielle, you grant us permission to:

  • Read your theme files: To display previews and understand your theme structure.
  • Write to your theme files: To publish pages, sections, and templates that you create using the editor.

You understand and agree that:

  • Lurielle will only modify theme files as a direct result of your explicit actions (e.g., clicking “Publish”).
  • We will never delete existing theme files without your explicit confirmation.
  • You are responsible for maintaining backups of your theme. While we take care to make non-destructive changes, we recommend using Shopify’s built-in theme duplication feature before publishing.
  • You may revoke Lurielle’s access at any time by uninstalling the app from your Shopify admin panel.

4. Account Registration

Your Lurielle account is created automatically when you authorize the app through Shopify. You are responsible for:

  • Maintaining the security of your Shopify account credentials
  • All activity that occurs under your account through the Service
  • Ensuring you have the authority to connect the Shopify store to the Service

5. Waitlist

If you join our waitlist, you agree to receive email communications from us regarding the Service launch and updates. You may unsubscribe at any time by contacting us at support@lurielle.studio.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of any third party
  • Transmit malicious code, spam, or harmful content through the Service
  • Attempt to gain unauthorized access to our systems or other users’ accounts
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Resell, sublicense, or redistribute the Service without our written consent

7. Intellectual Property

Our Intellectual Property

The Service, including its original content (excluding user content), features, and functionality, is and will remain the exclusive property of Lurielle. The Service is protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain all rights to the pages, designs, and content you create using the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service (e.g., generating previews, publishing to your theme).

AI-Generated Content

Content generated by AI features within the Service is provided for your use. You are responsible for reviewing and approving all AI-generated content before publishing. We make no guarantees regarding the accuracy, originality, or suitability of AI-generated content.

8. Theme Data and User Content

You acknowledge that:

  • You own or have the right to use all content and designs you create or publish through the Service.
  • We process your theme data in accordance with our Privacy Policy.
  • Published pages become part of your Shopify theme and are governed by your agreement with Shopify.
  • We do not claim ownership of any content published to your Shopify store.

9. Service Availability

We strive to ensure the Service is available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance and updates
  • Emergency maintenance or security patches
  • Factors beyond our control (including Shopify API availability)

We will make reasonable efforts to notify users in advance of planned downtime.

10. Third-Party Services

The Service integrates with third-party services, primarily Shopify. Your use of these third-party services is governed by their respective terms and conditions. We are not responsible for the availability, accuracy, or practices of third-party services.

11. Fees and Payment

Pricing for the Service will be announced at launch. We reserve the right to introduce, modify, or discontinue pricing plans. Any changes to pricing will be communicated in advance.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be error-free or uninterrupted
  • The results obtained from the Service will be accurate or reliable
  • AI-generated content will be free of errors, bias, or intellectual property issues
  • The Service will be compatible with all Shopify themes

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LURIELLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Damage to your Shopify theme or store resulting from publishing errors
  • Service interruptions or data loss
  • Any issues arising from AI-generated content

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Lurielle and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination:

  • Your right to use the Service will cease immediately.
  • Pages already published to your Shopify theme will remain in your theme (they are part of your store, not our Service).
  • We will delete your account data in accordance with our Privacy Policy.

You may terminate your account at any time by uninstalling Lurielle from your Shopify admin panel.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration or in the courts of competent jurisdiction.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lurielle regarding the Service and supersede any prior agreements.
